The Head Office of ETokina Technologies Pvt. Ltd is located at 140 A, Saraswati Nagar, Near Railway Headquarters, Malviya Nagar, Jaipur- Rajasthan- India. The given terms and conditions apply to be worked from any office of ETokina Technologies Pvt. Ltd.

ETokina is a multi-faceted and fast-growing IT company based in India. The company was established in the year 2013, the owners and the core team of ETokina has an amazing experience of over 12 years in the industry. By delivering innovative solutions with the highest level of knowledge and quality, the company aims to become a market leader and aspire to be the first choice of customers. ETokina is not a typical web development agency. It is focused on making things work for its customers. We craft websites that are simple to use, maintaining a flair and exuberance at the same time, you won’t find anywhere else.

• ETokina manages projects on time and materials basis.
• All rates are estimated and exclusive of any other taxes as may be applicable
• Dedicated resource(s) are granted to the clients with the necessary support staff like a Team Leader or
 Project Manager (if requested).
• The Jaipur office operates Monday – Friday, 10 AM to 7:00 PM (India’s time zone is GMT +
5:30 / BST +4.30).

All the public holidays are communicated by the development team directly to the clients; these holidays are further compensated by working extra in evening or on weekends and the result is provided as per the time schedule agreed with the clients.

What our clients should do

• It is expected from you to reply promptly in some communication. The developers are always ready to work. They must have tasks to perform for avoiding any kind of delay, as delay may increase the time required to complete the project.
• Please inform us beforehand if you are going to be away or unable to respond us.
• Please be connected with us and check your emails, skype etc. on daily basis.
• If you are not satisfied with the services provided by us, kindly let us know. We can work on them only if we know about them.

Acceptance of Services

• Throughout the project, at various levels and different intervals, we will be asking you to view, test and sign off few sections.
• As these small sections combines to form the project, we hope you cooperate with us in timely manner. Even if there is a minor delay in every section, it may cause a huge delay to the project as a whole.
• Once the project is completed, it is then tested accordingly. If any failure occurs while testing, and the defect detected is caused by any act of omission of you,
or by one of your subcontractors or agents, the project will be considered to passed the test. We can offer you assistance for any defect that is not caused by ETokina. But, this would cost aditional fees and prices.
• It is the responsibility of client to have a back-up of the work. We suggest our clients to have backup at evry stage. We do not take any responsibility for any impact of not having a back-up.

About Invoices

Payment of the first invoice/ advance is considered as the acceptance of all these terms and conditions.

The rates are calculated in according to the ETokina’s standard rates as follows:

• Weekly charges are calculated on the basis of eight (8) hours a day, working five (5) days a week, and if really urgent, we can work on the first and third saturdays of month.
• Daily charges are calculated on the basis of working eight (8) hours a day.
• charges are calculated as per the working hours being held for your project, all of which should be used within six (6) months of the time of reserving.
• All invoices ought to be paid in the currency wherein they’re issued.
• Our invoices are issued earlier than we begin the work and need to be reconciled in order for the work to begin.
• Your assignment can be placed on reserve while your payment on invoices is remaining and in that event we reserve
 the right to put off task documents from our servers.
• Until in any other case stated all fees are exclusive of VAT or any other taxes as may be relevant, which shall where 
applicable be charged by ETokina to you at the contemporary fee.

Termination

We reserve the right to terminate the project or services without liability to you if:

• You fail to pay any quantity due to us at the due date for the charge and continue to be in default no longer less than 7 days after being notified in writing to make such payment.
• You commit a material breach of any of our other terms and conditions of business, wherein the breach is incapable of treatment, or (if the breach is capable of remedy) you fail to treat the breach within 14 days after being notified in writing to do so.
• You breach any of our terms and conditions of enterprise in this sort of way as to moderately justify the opinion that your behavior is inconsistent together with your having the goal or capability to offer effect to the phrases of the agreement between us.
• you are made bankrupt, a winding-up order is made against you or you grow to be difficult to any insolvency manner such as management, liquidation or a voluntary association with your lenders pursuant to the Insolvency Act 1986 or different insolvency regulation.
• Throughout the development, the mission becomes unworkable or undeliverable, except in which this arises from a fault on ETokina part.

On termination of the project for any motive

• You shall right away pay to us all of ETokina outstanding unpaid invoices and interest (if any), according to the services furnished but for which no invoice has been submitted, we can also put up a bill, which will be payable immediately on receipt.
• All licenses granted via ETokina beneath the project shall terminate; and
• The collected rights of ETokina and liabilities of you as at termination shall now not be affected.

Warranty

The Customer must make ETokina aware(in written) during a 30 days Warranty Period if the client finds any error in 
the code or program developed by ETokina. Once agreed, we will correct the errors we made in code/ system or program at no cost. Under no circumstances, partial / full refund will be acknowledged.

ETokina wil not be answerable under the clauses:

• If the mistake isn’t notified to the ETokina team in writing throughout the warranty duration;
• If the mistake cannot be checked or reproduced by ETokina team.
• If and to the peak that the error is a result of infringement by means of the customer or involvement of
 developer / freelancer / company not related to ETokina.
• If the software program / applications / scripts (however not limited to) turned into written or advanced by a 
developer / freelancer / agency who isn’t related to ETokina or is in partially finished level.
• Because of a alternate in configuration of server / web hosting at customer side.
• We make no warranties or representations that your code / device / program will be commercially profitable
 or reach another supposed cause you may have for it. These may include many factors that are beyond our control.
• Involvement of 3rd party developer / freelancer / employer during or after of entirety of work (in such instances 
we want to be notified previous to the beginninf of a project)

You will meet the price of any time spent tracking bugs because of statistics/data content uploaded via customer or a 3rd party which

Ways to resolve problems

• Your Developer if working underneath Design & Development Model A or Model D.
